Terms of Use
1. Introduction
Welcome to our website. By browsing and using this site — or by submitting an enquiry, requesting a quotation, or proceeding with an installation — you're agreeing to comply with and be bound by the following terms and conditions.
These apply to all enquiries, quotations, advertising, installations, and services provided by Evolved Solar & Electrical Pty Ltd as trustee for The Evolved Industries Trust (ABN 31 360 354 492).
If you disagree with any part of these terms, please feel free to close the tab.
2. Accuracy of Information
We do our best to keep everything on this site up to date and accurate, especially when it comes to the ever-evolving world of solar technology. However, we don't provide any warranty or guarantee as to the accuracy, timeliness, or completeness of the information found here.
Use the info at your own risk — it's your responsibility to ensure that any products or services mentioned meet your specific requirements.
3. Intellectual Property
This website contains material which is owned by or licensed to Evolved Solar & Electrical. This includes, but isn't limited to, the design, layout, look, appearance, and graphics. Reproducing them without our permission is strictly prohibited.
4. External Links
From time to time, we might link to other websites (like our partners Brighte or Plenti). These links are provided for your convenience to provide further information. They don't signify that we endorse the website(s), and we have no responsibility for the content on those linked sites.
5. Pricing & Quotations
Any pricing mentioned on the site or generated through our "Get a Quote" form is an estimation based on the info provided — it's not a fixed or binding offer. All pricing discussed verbally, via surveys, forms, or advertising is indicative only.
Final pricing is subject to site inspection, system design, compliance requirements, and approval processes, and a binding quote is only provided after a full assessment and formal contract have been completed.
Pricing is generally discussed inclusive of applicable rebates and incentives, unless otherwise stated. Where GST applies, pricing will be clearly identified as inclusive or exclusive. We don't advertise or guarantee "from" pricing.
6. Government Rebates & Incentives
Small-scale Technology Certificates (STCs) and battery rebates are government-regulated and may change without notice.
Any rebate values referenced in our advertising, surveys, or discussions are estimates only — actual eligibility and values depend on things like system design, installation date, funding availability, and government policy.
Final rebate approval and value aren't guaranteed until confirmed by the relevant authority, and we're not responsible for any changes, reductions, delays, or withdrawal of rebate or incentive programs.
7. Advertising & Promotions (Including Facebook Advertising)
Our advertising may reference statements such as "up to $x in solar and battery rebates." These "up to" amounts represent the maximum potential incentives available and aren't guaranteed — actual eligibility and rebate values vary by household, system configuration, electrical supply, and government criteria.
Our advertising is provided for general information only and doesn't constitute a binding offer.
8. Energy Savings, Performance & Modelling
Any projected savings, payback estimates, or performance figures we provide are estimates only. These are generated using industry-standard modelling software (including Pylon Observer) and informed by real-world installation experience, but results vary based on usage patterns, tariffs, weather conditions, household behaviour, and grid factors.
We don't guarantee bill elimination, specific savings outcomes, or financial returns.
9. Battery Systems, Backup Power & Blackouts
Battery systems may provide blackout protection depending on system design, inverter capacity, and connected loads. Backup capability, duration, and available loads all vary by installation, and certain high-demand or three-phase appliances may be limited during grid outages depending on your system configuration.
Any known limitations will be disclosed during the design and quotation process. It's worth keeping in mind that battery systems aren't a substitute for unlimited grid supply.
10. Site Conditions, Variations & Compliance
Quotations are prepared based on the information available at the time of site inspection. If unforeseen site conditions, safety issues, or compliance requirements come up, we reserve the right to propose variations — but any variations will always be discussed with you prior to work proceeding.
You're also free to engage an alternative contractor for variation works if you prefer, provided compliance requirements are met.
11. Deposits, Payments & Cancellations
A deposit of 70% of the out-of-pocket cost (after applicable STCs) is required to secure equipment and lock in your installation.
Once equipment has been ordered or applications lodged, deposits become non-refundable. Prior to equipment being ordered, deposits may be partially refundable at our discretion.
If you cancel after acceptance, approvals, or ordering, there may be costs associated with equipment, administration, and third-party services.
12. Workmanship & Warranties
A 10-year workmanship guarantee applies to all installation work we carry out.
Manufacturer warranties apply separately to panels, inverters, batteries, and associated equipment, and online system monitoring may be provided during the warranty period where applicable.
Warranty coverage excludes misuse, unauthorised modification, external damage, or factors beyond our control.
13. Insurance & Licensing
We hold public liability insurance of up to $20 million and maintain professional indemnity insurance where required. All works are completed by appropriately licensed and accredited professionals.
14. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the value of the works performed. We're not liable for any indirect, consequential, or economic losses arising out of, or in connection with, the use of this website or our services.
Nothing in these terms limits your rights under Australian Consumer Law.
15. Privacy, Contact & Marketing Consent
By submitting an enquiry or form, you're consenting to being contacted by us via phone, SMS, or email regarding your enquiry. We may follow up to provide information relating to assessments, quotations, or services.
Your personal information is handled in accordance with our Privacy Policy and applicable privacy laws.
16. Testimonials & Reviews
Testimonials on our site reflect individual customer experiences. Results may vary, and testimonials don't guarantee similar outcomes for you.
17. Governing Law
These terms and conditions are governed by the laws of Queensland, Australia.
